Nnochiri\u003C\u002Fstrong>\u003C\u002Fp>\n\n\n\n\u003Cp>The Court of Appeal sitting in Abuja, on Thursday, vacated the judgment that nullified the timelines the Independent National Electoral Commission (INEC) issued for the 2027 general elections.\u003C\u002Fp>\n\n\n\n\u003Cp>The appellate court, in a unanimous decision by a three-member panel, upheld as meritorious, an appeal the electoral body filed to challenge the judgment the Federal High Court delivered on May 20.\u003C\u002Fp>\n\n\n\n\u003Cp>According to the appellate court, the trial court failed to follow binding precedents, adding that the Revised Timetable the INEC issued for the general elections is legally considered subsidiary legislation to the 2026 Electoral Act.\u003C\u002Fp>\n\n\n\n\u003Cp>It held that such subsidiary legislation has the same force of law as the Electoral Act, adding that the INEC acted within its statutory powers.\u003C\u002Fp>\n\n\n\n\u003Cp>The appellate court maintained that every deadline in the Revised Timetable for the 2027 general elections fell within the ambit of the Electoral Act.\u003C\u002Fp>\n\n\n\n\u003Cp>INEC had in its notice of appeal dated May 25, raised nine grounds it urged the appellate court to consider and vacate the high court judgment.\u003C\u002Fp>\n\n\n\n\u003Cp>Aside from its contention that the high court erred in law when it failed to determine a jurisdictional issue it raised, INEC maintained that the legal action the Youth Party (YP) initiated against it was not only hypothetical but academic.\u003C\u002Fp>\n\n\n\n\u003Cp>It argued that failure of the trial court to make pronouncements on the issues resulted in the denial of fair hearing to the Appellant.\u003C\u002Fp>\n\n\n\n\u003Cp>More so, INEC insisted that the high court erred in law when it held that: “It is clear from the wordings of Sections 29(1), 82 and 84 of the Electoral Act, 2026, the following can be understood. Section 29(1) of the Electoral Act, 2026 mandates Political Parties to submit the names of candidates in prescribed forms of the candidates who emerged from their valid primaries which such a political party intends to sponsor at\u003Cbr>the elections, not later than 120 days before the date of the General Election.\u003C\u002Fp>\n\n\n\n\u003Cp>“What is required of Political Parties to do under the Electoral Act, 2026 is to notify the Independent National Electoral Commission (INEC) 21 days before the holding of its primaries, congresses or conventions, days before the holding of its primaries, congresses or conventions, or any conference or meeting convened for the election of its executive committees, other governing bodies for nominating candidates.\u003C\u002Fp>\n\n\n\n\u003Cp>“The Defendant is not mandated to impose a timeframe for political parties to conduct their primaries provided that it will be done and submitted not later than the 120 days provided by the Electoral Act, 2026. See Section 82(1) of the Electoral Act, 2026.”\u003C\u002Fp>\n\n\n\n\u003Cp>INEC argued that the verdict of the trial court was against the weight of evidence that was placed before it by the parties.\u003C\u002Fp>\n\n\n\n\u003Cp>It prayed the appellate court for an order allowing the appeal and setting aside the judgment\u003C\u002Fp>\n\n\n\n\u003Cp>The electoral body further urged the Court of Appeal to strike out YP’s case on the ground that it lacked the locus standi (legal right) to institute and maintain the action it said was merely academic.\u003C\u002Fp>\n\n\n\n\u003Cp>It will be recalled that the high court had in the judgment that was delivered by Justice Mohammed Umar, invalidated the timeline the INEC issued for the conduct of primaries and the nomination of candidates.\u003C\u002Fp>\n\n\n\n\u003Cp>The court also set aside INEC’s May 10 deadline requiring political parties to submit a register and database of all their members as a condition for qualifying to participate in the general elections.\u003C\u002Fp>\n\n\n\n\u003Cp>It held that the time frame the Commission imposed for political parties to conduct their primaries and to submit, withdraw, or replace the names and particulars of their candidates for the general elections “is inconsistent with the provisions of the Electoral Act, 2026.”\u003C\u002Fp>\n\n\n\n\u003Cp>The judgment followed YP’s suit to compel the electoral body to comply with the Electoral Act 2026’s 120-day pre-election deadline for submitting party registers and candidates’ personal particulars.\u003C\u002Fp>\n\n\n\n\u003Cp>INEC was listed as the sole defendant in YP’s suit marked: FHC\u002FABJ\u002FCS\u002F517\u002F2016.\u003C\u002Fp>\n\n\n\n\u003Cp>The plaintiff had prayed the court to declare that, upon a proper consideration and interpretation of the provisions of Sections 29, 82, and 84(1) of the Electoral Act, 2026, the powers of INEC to receive notice of party primaries and the personal particulars of candidates, and its duty to attend, observe, and monitor such primaries, do not extend to fixing or prescribing the timetable within which political parties may conduct their primary elections for the purpose of nominating candidates for the 2027 general elections.\u003C\u002Fp>\n\n\n\n\u003Cp>While agreeing with the YP, Justice Umar declared that in view of the provisions of Section 29(1) of the Electoral Act, 2026, which requires political parties to submit the personal particulars of their candidates not later than 120 days to an election, “INEC cannot lawfully abridge or limit that statutory period by prescribing a shorter timeframe in its 2027 election timetable.”\u003C\u002Fp>\n\n\n\n\u003Cp>Likewise, the court held that in line with Section 31 of the Electoral Act 2026, which permits political parties to withdraw and substitute candidates not later than 90 days before the conduct of an election, INEC lacks the power to abridge or limit that statutory period by fixing an earlier deadline for the withdrawal and replacement of candidates in its 2027 election timetable.\u003C\u002Fp>\n\n\n\n\u003Cp>Justice Umar further held that, by the provisions of Section 32 of the Electoral Act, 2026, INEC does not possess the statutory power to publish the final list of candidates for the 2027 general election before the 60-day minimum That’s a point that I have been making for a long time, and that statement was meant to address contemporary issues on the table in Nigeria, more so in northern Nigeria.\u003C\u002Fp>\n\n\n\n\u003Cp>“This is because those of us from this part of the country that had supported the Obi-Kwankwaso ticket are being called several different names by ignorant people who have no history of the Nigerian state.\u003C\u002Fp>\n\n\n\n\u003Cp>“If they heard what Kwankwaso said, it’s not new because during the First Republic and before it, I mean, before independence, the northern leaders, led by Ahmadu Bello, Kashim Ibrahim, the former governor of northern region, and a host of others had worked together with the NCNC under Dr. Nnamdi Azikiwe, Dr. Ndili, Chief Melford Okilo, and a host of others to fight for independence.\u003C\u002Fp>\n\n\n\n\u003Cp>“And when 1960 came, Dr. Nnamdi Azikiwe and Ahmadu Bello teamed up together to rescue power from the colonial masters. Then Dr. Azikwe became the president of Nigeria and the commander-in-chief of the armed forces, while Balewa, representing the NPC, became the prime minister and head of government.\u003C\u002Fp>\n\n\n\n\u003Cp>“And at that time, the unity and plurality of government was not in question. There was everybody in that government.\u003C\u002Fp>\n\n\n\n\u003Cp>“Unfortunately, that unity in diversity was truncated in 1966. A lot of people gave it different coloration. I am sure, in my mind, that nobody would want to destroy his house. Neither did Opara, Mbadiwe, Akiloye or Akinjide, who are prominent members of that government, wouldn’t have advocated for the coming of the military.\u003C\u002Fp>\n\n\n\n\u003Cp>“So, if anything had happened, I would rather blame the military than blame civilian members of that government, and certainly not the generality of the people.\u003C\u002Fp>\n\n\n\n\u003Cp>“We have been called several names, saying we are bringing an Igbo man. Unfortunately, it’s not only the government of APC, even some opposition political parties, instead of us fighting our common opponent, that is the APC and its government, we are fighting ourselves.\u003C\u002Fp>\n\n\n\n\u003Cp>“And we asked, where did we pick Obi from? Where did we get Obi from? We got Obi from Atiku. He was his vice presidential candidate.\u003C\u002Fp>\n\n\n\n\u003Cp>“Atiku ran with Senator Ben Obi as vice presidential candidate. He ran with Peter Obi as vice presidential candidate. He ran with Okowa as vice presidential candidate. Now we are hearing he is going to run with Amechi as vice presidential candidate.\u003C\u002Fp>\n\n\n\n\u003Cp>“So, can anybody supporting Atiku be right in denigrating us that we are promoting Igbo Abumisi, National President of the NUP, issued the directive in Abuja during the commissioning of the Comrade Godwin Abumisi Pensioners’ Legacy House — a new multi-purpose hall and apartment complex at the union’s national headquarters.\u003C\u002Fp>\n\n\n\n\u003Cp>Speaking to dignitaries, labour leaders and pensioners from across the country, Abumisi said President Tinubu’s administration has shown strong commitment to pensioners’ welfare, citing approved pension increases, payment of arrears and settlement of accrued entitlements.\u003C\u002Fp>\n\n\n\n\u003Cp>He promised the union would return the President’s goodwill with overwhelming electoral support in 2027.\u003C\u002Fp>\n\n\n\n\u003Cp>Abumisi said: “We express our profound gratitude to President Bola Ahmed Tinubu and his administration for providing an enabling environment for Nigerian pensioners and our union through his sustained approval for a series of pension increases, payment of pension arrears and accrued rights, which has consequently energized our resource base.”\u003C\u002Fp>\n\n\n\n\u003Cp>He further said: “We shall never forget this goodwill in a hurry, as we also promise to reciprocate the kind gesture at the appropriate time soonest.”\u003C\u002Fp>\n\n\n\n\u003Cp>The declaration was greeted with applause from hundreds of pensioners who attended the event, signalling what observers described as the union’s first formal political endorsement ahead of the 2027 presidential election.\u003C\u002Fp>\n\n\n\n\u003Cp>Abumisi urged pensioners nationwide to remain united behind the administration, insisting that the President had shown genuine concern for the welfare of senior citizens through policies aimed at improving their living conditions.\u003C\u002Fp>\n\n\n\n\u003Cp>The NUP President recounted the journey that culminated in the completion of the Legacy House, describing the project as a fulfilment of his administration’s vision to leave the union stronger than it met it.\u003C\u002Fp>\n\n\n\n\u003Cp>According to him, the project began in 2019 when his predecessor, Dr. Abel Afolayan, acquired the land for ₦60 million, while his administration prioritised the construction of the edifice as a lasting symbol of unity and pride for pensioners nationwide.\u003C\u002Fp>\n\n\n\n\u003Cp>“In my vision to leave the union better than I met it, I made the construction of this Legacy House the topmost priority of my administration to serve as a symbol of unity and pride for the Nigeria Union of Pensioners and pensioners across the country,” he said.\u003C\u002Fp>\n\n\n\n\u003Cp>Abumisi equally announced that the union had immortalised key personalities who had contributed to its growth and the completion of the project.\u003C\u002Fp>\n\n\n\n\u003Cp>He disclosed that the two topmost apartments in the building had been named after Kano State Governor, Abba Kabir Yusuf, and Niger State Governor, Mohammed Umar Bago, in appreciation of their financial, moral and logistical support to the union during its 2025 National Delegates Conference in Kano.\u003C\u002Fp>\n\n\n\n\u003Cp>According to him, the governors’ support significantly contributed to the successful execution of the project.\u003C\u002Fp>\n\n\n\n\u003Cp>The NUP President also announced that two other apartments would bear the names of former union presidents, Chief Laleye Adegun and Alhaji Ali Abatcha, while the 200-seat auditorium had been named after the immediate past National President, Dr. Abel Afolayan, in recognition of their meritorious service to the union.\u003C\u002Fp>\n\n\n\n\u003Cp>He further revealed that the entire complex had been officially christened “Comrade Godwin Abumisi Pensioners’ Legacy House” following a that the party did not explain how the guidelines affected it and it’s members in the conduct of its primary election for the nomination of candidates for the 2027 three Justices unanimously agreed that Justice Mohammed Garba Umar of the Federal High Court, who on May 20 nullified the guidelines on the ground that it violated some provisions of the Electoral Act, did so in gross errors and led to miscarriage of justice.\u003C\u002Fp>\n\n\n\n\u003Cp>INEC which filed an application against the high court decision had argued that the lower court erred in law elections.\u003C\u002Fp>\u003Cp>The court held that the time frame the electoral umpire announced for political parties to conduct their primaries and to submit, withdraw, or replace the names and particulars of their candidates for the general elections “is inconsistent with the provisions of the Electoral Act, 2026.”\u003C\u002Fp>\u003Cp>But in the appeal dated May 25, 2026, filed by INEC, through its counsel, Izinyon (SAN), the electoral body prayed the court to set aside the judgment.\u003C\u002Fp>\u003Cp>The senior advocate, in the appeal, also asked the court to stay the execution
