That is my first submission, my lord,” he said.\u003C\u002Fp>\n\n\n\n\u003Cp>The judge then asked Sowore what he wanted.\u003C\u002Fp>\n\n\n\n\u003Cp>“Do you want to proceed?” Justice Umar asked.\u003C\u002Fp>\n\n\n\n\u003Cp>Responding, Sowore said, being a serious case, he would be asking for an adjournment.\u003C\u002Fp>\n\n\n\n\u003Cp>“I will urge your lordship to adjourn the matter because it is a serious case and I will need a lawyer to defend me,” he said.\u003C\u002Fp>\n\n\n\n\u003Cp>The defendant also begged the court to allow him make another application.\u003C\u002Fp>\n\n\n\n\u003Cp>But the judge told Sowore that if he applied to make another application other than the issue of adjournment, that would mean that he had decided to represent himself in court.\u003C\u002Fp>\n\n\n\n\u003Cp>“If you want to take up the case let us know.\u003C\u002Fp>\n\n\n\n\u003Cp>“If you have any application to make, it means you are planning to defend yourself.\u003C\u002Fp>\n\n\n\n\u003Cp>“If you are seeking an adjournment that your counsel is not in court, that will be considered after hearing from the prosecution.\u003C\u002Fp>\n\n\n\n\u003Cp>“But if you are making an application, it means you are telling this court that you are taking over the defence on your own,” the judge said.\u003C\u002Fp>\n\n\n\n\u003Cp>In his response, the DSS’s lawyer said that Sowore’s application for adjournment would be the 11th time the trial had been adjourned at the instance of the defence.\u003C\u002Fp>\n\n\n\n\u003Cp>“With respect, this matter came up on July 13, 2027, and the defence counsel made an application for adjournment and the court adjourned to today because of the fact that their next set of witnesses are subpoenaed witnesses and your lordship signed the subpoena.\u003C\u002Fp>\n\n\n\n\u003Cp>“This same excuse was given that the lead counsel was absent at the last adjourned date and this court said that the absence of lead counsel cannot stop this proceeding,” he said.\u003C\u002Fp>\n\n\n\n\u003Cp>Kehinde also argued that there was a subsisting order of the court that the trial was to be conducted day-to-day.\u003C\u002Fp>\n\n\n\n\u003Cp>He said today’s application made it 11 times the defence would be making such a request, contrary to the provisions of the Administration of Criminal Justice Act (ACJA), 2015.\u003C\u002Fp>\n\n\n\n\u003Cp>The senior lawyer submitted that it was crystal clear that Sowore was not ready to proceed with his defence.\u003C\u002Fp>\n\n\n\n\u003Cp>He, therefore, applied that his defence should be foreclosed.\u003C\u002Fp>\n\n\n\n\u003Cp>“I urge your lordship, in the interest of justice which is a three-way traffic – justice for the prosecution, the defence and the society – to foreclose the defence and make a consequential order accordingly,” he applied.\u003C\u002Fp>\n\n\n\n\u003Cp>Ruling, Justice Umar said he will give Sowore the last opportunity in the interest of fair hearing.\u003C\u002Fp>\n\n\n\n\u003Cp>“I have heard the application of the defendant, seeking adjournment of the case on the basis that his lead counsel was not in court.\u003C\u002Fp>\n\n\n\n\u003Cp>“The defendant clearly stated that this is a serious matter to which the lead counsel needs to give serious attention to same.\u003C\u002Fp>\n\n\n\n\u003Cp>“I equally listened to counsel to the prosecution that this is the 11th adjournment and that the defendant’s defence should be foreclosed.\u003C\u002Fp>\n\n\n\n\u003Cp>“Fair hearing demands that all parties be heard and defendant present his defence before court,” he said.\u003C\u002Fp>\n\n\n\n\u003Cp>The judge said that, though the court cannot compel the defendant to defend himself, he would concede to Sowore’s application for adjournment.\u003C\u002Fp>\n\n\n\n\u003Cp>Justice Umar, however, warned that if he failed to continue with his defence on the next adjourned date, his defence may be foreclosed.\u003C\u002Fp>\n\n\n\n\u003Cp>The judge adjourned the matter until July 22 for definite continuation of defence.\u003C\u002Fp>\n\n\n\n\u003Cp>However, shortly after the ruling, Sowore indicated his interest in addressing the court and the judge granted him leave.\u003C\u002Fp>\n\n\n\n\u003Cp>The defendant therefore applied for his international passport to be submitted at the U.S. Embassy in order to address a family matter.\u003C\u002Fp>\n\n\n\n\u003Cp>“I want to bring it to your lordship’s attention various serious issues. I have a family emergency which requires that my passport be given to US Embassy so that my children in the U.S. can attend to some emergencies,” he said.\u003C\u002Fp>\n\n\n\n\u003Cp>But Justice Umar S. Idris of FCT High Court 25 after the court found him guilty of culpable homicide in connection with the incident, which occurred on January 6, 2024, at a hotel in the Kubwa area of Abuja.\u003C\u002Fp>\n\n\n\n\n\n\n\n\u003Cp>FCT Police spokesperson, SP Josephine Adeh, said the command initially charged Bassey with culpable homicide punishable with death under Sections 220(a) and (b) and Section 221 of the Penal Code Law, following the conclusion of investigations into the incident.\u003C\u002Fp>\n\n\n\n\n\n\n\n\u003Cp>She said evidence presented before the court showed that the accused and the deceased were friends, adding that the incident occurred after a disagreement between both men at the birthday celebration organised by Nnonifu escalated into a physical confrontation.\u003C\u002Fp>\n\n\n\n\n\n\n\n\u003Cp>“The prosecution led evidence establishing that the defendant assaulted the deceased by slapping and pushing him, causing him to fall and hit his head on a concrete surface. He also asked for more time to complete the fresh filing.\u003C\u002Fp>\n\n\n\n\u003Cp>Speaking to journalists after the hearing, prosecution lawyer Ibrahim Muktar criticised the move, saying the defence had continued to file applications that were delaying the trial.\u003C\u002Fp>\n\n\n\n\u003Cp>According to him, two more applications asking the judge to recuse himself were also filed after the last adjournment.\u003C\u002Fp>\n\n\n\n\u003Cp>Muktar described the latest application as “a delay method” and said the prosecution was ready to proceed with the trial.\u003C\u002Fp>\n\n\n\n\u003Cp>He said, “Charge has been filed, prosecution is ready, defense is bringing multiple application and that is what is destroying the time, frustrating the prosecution from commencing the trial, we would have gone far if not because of these applications.”\u003C\u002Fp>\n\n\n\n\u003Cp>The court granted the defence more time and adjourned the case until July 22, 2026, for hearing.\u003C\u002Fp>\n\u003Cp>\u003Ca (FCT).\u003C\u002Fp>\n\n\n\n\u003Cp>Justice Joyce Abdulmalik denied John Jude Agbo bail after the prosecution presented a fourth witness and, thereafter, closed its case against him.\u003C\u002Fp>\n\n\n\n\u003Cp>Agbo faces terrorism and cybercrime charges for allegedly planning to harm the schools, their students and teachers.\u003C\u002Fp>\n\n\n\n\u003Cp>Ruling on the defendant’s bail application, the trial judge held that there was no evidence to show that Agbo would not jump bail. The judge ordered that he be remanded in the custody of the Nigerian Correctional Service (NCS).\u003C\u002Fp>\n\n\n\n\u003Cp>Earlier, the witness, a DSS officer, told the court how his team investigated Agbo and some of his collaborators.\u003C\u002Fp>\n\n\n\n\u003Cp>The witness tendered an audio-visual recording of Agbo’s interview session, which was admitted in evidence and played in open court.
