Crime Act (Amendment) Bill, 2026, citing the need to address substantive drafting, legal and policy issues identified after the legislation was approved on July 9, 2026.\u003C\u002Fp>\n\n\n\n\u003Cp>Moving the motion, Senate Leader, Senator Opeyemi Bamidele, said the chamber had discovered fundamental concerns that required further legislative scrutiny and refinement to ensure the bill achieved its intended objectives.\u003C\u002Fp>\n\n\n\n\u003Cp>He noted that leaving the identified issues unresolved could undermine the effective implementation of the proposed law and create unintended legal and operational consequences.\u003C\u002Fp>\n\n\n\n\u003Cp>According to him, it was in the overriding public interest for the Senate to revisit the bill to ensure that it conforms with international best practices on asset recovery, proceeds of crime management, and Nigeria&#8217;s constitutional and legal framework.\u003C\u002Fp>\n\n\n\n\u003Cp>Relying on Orders 1(b) and 52(6) of the Senate Standing Orders (2023–2027), Bamidele urged the Senate to rescind its earlier decision to allow for comprehensive review of the contentious provisions.\u003C\u002Fp>\n\n\n\n\u003Cp>The motion sparked a brief procedural clarification after former Senate Leader, Senator Yahaya Abdullahi, raised concerns over whether the motion had been properly listed on the supplementary Order Paper.\u003C\u002Fp>\n\n\n\n\u003Cp>Presiding Senate President Godswill Akpabio clarified that the motion was validly brought under Order 1(b), while Bamidele explained that Abdullahi&#8217;s intervention was purely procedural and not an objection to the substance of the motion.\u003C\u002Fp>\n\n\n\n\u003Cp>Abdullahi subsequently seconded the designate.\u003C\u002Fp>\n\n\n\n\u003Cp>Fasina&#8217;s confirmation followed the consideration of the report of the Senate Committee on Foreign Affairs, chaired by Senator Sani Bello (APC, Niger North).\u003C\u002Fp>\n\n\n\n\u003Cp>The report was presented by Senator Simon Lalong (APC, Plateau South).\u003C\u002Fp>\n\n\n\n\u003Cp>Presenting the report, Lalong said, &#8220;That the Senate do receive and consider the report of the Committee on Foreign Affairs on the confirmation of the nomination of Professor Abayomi Sunday Fasina for appointment as Non-Career Ambassador\u002FHigh-Commissioner of the Federal Republic of Nigeria.&#8221;\u003C\u002Fp>\n\n\n\n\u003Cp>Soon after the presentation of the report, while some Senators kicked against his clearance, some were in support, especially Senate President Godswill Akpabio and Senator Abdul Ningi (Bauchi Central).\u003C\u002Fp>\n\n\n\n\u003Cp>Senator Cyril Fasuyi (APC, Ekiti North), a member of the Foreign Affairs Committee, who was number 12 on the list and also signed that he should be confirmed, however, kicked against it.\u003C\u002Fp>\n\n\n\n\u003Cp>The committee, in its findings 6.0 item 4, stated: &#8220;that the accusation against Professor Fasina was investigated by competent authorities including the University Governing Council and the Nigeria Police, which both found the allegation false.&#8221;\u003C\u002Fp>\n\n\n\n\u003Cp>In his remarks, Akpabio thanked the committee for the work, noting that the committee received reports from the Police, the Department of State Services (DSS) and the university council. He warned senators to take their assignments with respect and not rely on hearsay.\u003C\u002Fp>\n\n\n\n\u003Cp>On July 7, 2026, a coalition of civil society organisations stormed the National Assembly, protesting against the nomination of Professor Fasina.\u003C\u002Fp>\n\n\n\n\u003Cp>The protesters called on the Senate not to confirm the nominee over allegations of sexual harassment, human rights violations and victimisation currently before the court.\u003C\u002Fp>\n\n\n\n\u003Cp>The coalition insisted that its campaign was aimed at promoting accountability, protecting victims of workplace sexual harassment, and preserving Nigeria&#8217;s credibility in the international community.\u003C\u002Fp>\n\n\n\n\u003Cp>According to them, Professor Fasina had pending cases before the National Industrial Court in Lagos and Abuja and argued that the Senate should allow the judicial process to run its course before considering his confirmation.\u003C\u002Fp>\n\n\n\n\u003Cp>Speaking on behalf of the coalition, Amira Adeyemo, a lawyer, said the protest was not driven by personal animosity but by a desire to protect Nigeria&#8217;s integrity and uphold justice.\u003C\u002Fp>\n\n\n\n\u003Cp>&#8220;I am here as a concerned Nigerian and a member of civil society, not because I have any personal vendetta against Professor Abayomi Sunday Fasina. Commission, FRSC, Act introducing stiffer penalties.\u003C\u002Fp>\n\n\n\n\u003Cp>Details of the FRSC Act (Amendment) Bill obtained by Vanguard, on Thursday, showed that fines for several offences were raised by up to 300%. The bill also reinforces penalties for offences, including a N50,000 fine for preaching or selling products inside public vehicles.\u003C\u002Fp>\n\n\n\n\u003Cp>According to the provision, any person found trading, hawking or preaching in commercial buses will be liable. On conviction, the offender will pay a N50,000 fine.\u003C\u002Fp>\n\n\n\n\u003Cp>Senators who debated the bill, titled Federal Road Safety Corps Act (Amendment), 2026 (HBs. 1401 &amp; 1604 – For Concurrence), which was first read in the Senate on July 1, 2025, argued that the increase was necessary to check recklessness on Nigerian roads and reduce crashes caused by distractions.\u003C\u002Fp>\n\n\n\n\u003Cp>“Our roads have become marketplaces and crusade grounds. This cannot continue. The penalties must hurt enough to change behaviour,” one lawmaker said during plenary.\u003C\u002Fp>\n\n\n\n\u003Cp>Other offences affected by the hike include driving under the influence of alcohol, use of phone while driving, overloading, seatbelt violation and driving without a valid licence.\u003C\u002Fp>\n\n\n\n\u003Cp>The second schedule of the amended Act, which will take effect after presidential assent, lists 52 offences and their penalties.\u003C\u002Fp>\n\n\n\n\u003Cp>Driving under the influence of alcohol, which previously attracted a N5,000 fine, will now attract a N100,000 fine or two years imprisonment or both.\u003C\u002Fp>\n\n\n\n\u003Cp>The provision states: “A person who, while driving or attempting to drive, or when in charge of a motor vehicle, is under the influence of intoxicating drugs or alcohol above the legal limit or to such an extent as to be incapable of having proper control of such motor vehicle, commits an offence and is liable on conviction to a fine of N100,000 or imprisonment for a term not exceeding two years or both.”\u003C\u002Fp>\n\n\n\n\u003Cp>It is also an offence to refuse to cooperate with FRSC officials when they request a preliminary roadside breath test based on reasonable suspicion. The offence attracts a fine of N50,000 or six months imprisonment or both.\u003C\u002Fp>\n\n\n\n\u003Cp>Failure to obey traffic lights, road signs, pavement or road markings will now attract a N100,000 fine.\u003C\u002Fp>\n\n\n\n\u003Cp>Speed limit violations will also attract N100,000, up from the previous N5,000. The same N100,000 fine applies to reckless driving, which also carries a two-year jail term or both.\u003C\u002Fp>\n\n\n\n\u003Cp>The Senate said the review was aimed at strengthening FRSC’s capacity to enforce road safety laws and protect lives.\u003C\u002Fp>\n\n\n\n\u003Cp>Transport operators and commuters are expected to feel the impact most, especially in Abuja, Lagos and other major cities where hawking and preaching in buses is common.\u003C\u002Fp>\n\n\n\n\u003Cp>FRSC has, in recent years, complained that weak penalties encourage traffic violations. It only becomes meaningful when it improves the lives of citizens,&#8221; he stated.\u003C\u002Fp>\n\n\n\n\u003Cp>The don recalled a nationwide survey conducted ahead of the 2015 general election, saying that he was part of a research team commissioned by then vice-president-elect, Prof. Yemi Osinbajo, to identify Nigerians&#8217; expectations of the incoming administration.\u003C\u002Fp>\n\n\n\n\u003Cp>He said the survey identified security as the country&#8217;s foremost concern, followed by the economy, corruption, infrastructure and education.\u003C\u002Fp>\n\n\n\n\u003Cp>Pate who is also a Professor of Communication at Bayero University, Kano, noted that while successive administrations have made efforts in these areas, Nigerians continue to assess democracy largely by improvements in their daily lives.\u003C\u002Fp>\n\n\n\n\u003Cp>He cited findings from the Afrobarometer survey across 39 African countries, which showed that while about two-thirds of Africans prefer democracy to other forms of government, only about 37 per cent were satisfied with how democracy worked in their respective countries.\u003C\u002Fp>\n\n\n\n\u003Cp>According to him, &#8220;This reflects a gap between citizens&#8217; commitment to democratic ideals and the actual outcomes of democratic governance.&#8221;\u003C\u002Fp>\n\n\n\n\u003Cp>The communication scholar also referenced findings from the 2024 African Young People Survey, which revealed that many young Africans are considering emigrating due to corruption and limited opportunities, warning that such sentiments pose serious questions about the future of democracy on the continent.\u003C\u002Fp>\n\n\n\n\u003Cp>Pate identified historical grievances, identity politics, social and economic exclusion, youth unemployment, weak institutions and governance deficits as major factors undermining democratic consolidation in Nigeria.\u003C\u002Fp>\n\n\n\n\u003Cp>He argued that: &#8220;Identity politics has continued to shape political participation, often placing greater emphasis on ethnicity, religion and place of origin than on competence and shared national values.&#8221;\u003C\u002Fp>\n\n\n\n\u003Cp>He also expressed concern over the collapse of local government institutions in many parts of the country, saying that grassroots governance had previously played a significant role in resolving community disputes, providing basic services and creating economic opportunities.\u003C\u002Fp>\n\n\n\n\u003Cp>The professor warned that: &#8220;Misinformation, hate speech and divisive narratives amplified through digital platforms are worsening existing social tensions. Ibrahim Magu, then acting Chairman of the Economic and Financial Crimes Commission, was picked up, detained and suspended from office, and made to answer before a presidential investigation panel chaired by Justice Ayo Salami, a retired President of the Court of Appeal. I know the events of those weeks more intimately than most, because I was his counsel. This week, six years on almost to the day, the Federal High Court in Abuja ordered the final forfeiture of forty-eight properties linked to Mr. Abubakar Malami, SAN, the former Attorney-General of the Federation and Minister of Justice, upon whose memorandum to the President the case against Magu had been built. The two events, read together, tell a story larger than either man, and it is that story, of process, of proof and of the long memory of the law, that this piece sets out to tell.\u003C\u002Fp>\n\n\n\n\u003Cp>\u003Cstrong>The Travail of Ibrahim Magu\u003C\u002Fstrong>\u003C\u002Fp>\n\n\n\n\u003Cp>The case against Magu arrived not by charge and arraignment but by memorandum: a catalogue of allegations from the office of the Attorney-General, ranging from insubordination to discrepancies in the accounting for recovered assets, which persuaded the President to convene the Salami panel. What followed was an ordeal by process of an unusual kind. The nation’s foremost anti-corruption officer was arrested without warrant, detained for days without charge, suspended from office while the inquiry into him had barely opened, and tried, in substance if not in form, before a panel sitting behind the walls of the Presidential Villa, beyond the ordinary guarantees of the open courtroom. As his counsel, I insisted then, publicly and before the panel, on the elementary things: that an accuser must prove, that a man must know and confront the case against him, that suspension is not conviction, and that an inquiry which will not publish its findings has punished a man’s name without judging his cause.\u003C\u002Fp>\n\n\n\n\u003Cp>The sequel vindicated the insistence. The panel’s report, submitted in November 2020, was never officially published; no White Paper ever issued; and, most eloquently of all, no charge was ever preferred against Ibrahim Magu in any court, then or since. He denied every allegation, returned to the Nigeria Police Force, was promoted to the rank of Assistant Inspector-General by the Police Service Commission in May 2022, and retired with that rank and his pension. I make no triumphal point. I record, rather, the melancholy one: an accusation of that magnitude, pressed with the full weight of the state and then simply abandoned, adjudicated by nobody, leaves everyone worse off, the accused, whose vindication is incomplete because it was never formally pronounced; the accusers, whose motives are forever open to question; and the public, which was promised accountability and given only spectacle. Accountability by ambush is not accountability at all. It is the personalisation of institutions, and institutions personalised in one season will be turned, in the next, upon the very hands that personalised them.\u003C\u002Fp>\n\n\n\n\u003Cp>\u003Cstrong>The Forfeiture of The Malami Properties\u003C\u002Fstrong>\u003C\u002Fp>\n\n\n\n\u003Cp>Which brings us to this week’s ruling. In January of this year, on the application of the EFCC, Justice Emeka Nwite of the Federal High Court ordered the interim forfeiture of fifty-seven properties, hotels, residential buildings, schools, lands and a printing press across Kebbi, Kano and the Federal Capital Territory, said by the Commission to be worth some two hundred and thirteen billion naira and linked to the former Attorney-General and two of his sons. The interim order did what interim forfeiture orders do: it preserved the assets and called upon all who claimed them to come and show cause why they should not be finally forfeited. On Wednesday, Justice Joyce Abdulmalik delivered the final ruling. Forty-eight of the properties were finally forfeited to the Federal Government, the court holding that the Commission had established a reasonable suspicion that they were proceeds of unlawful activity and that the respondents had failed to demonstrate the lawful origin of the funds with which they were acquired. Nine properties, in Kebbi and Kaduna, were released, the court finding the Commission’s proof wanting in respect of them. Separately, and importantly separately, Mr. Malami, his son and his wife face a sixteen-count money laundering charge involving some 8.7 billion naira, which remains to be tried.\u003C\u002Fp>\n\n\n\n\u003Cp>It is important that the public understand precisely what happened in that courtroom, because forfeiture of this kind is widely misunderstood. This was a non-conviction-based forfeiture: a civil proceeding directed at the property itself, not at the person, asking not ‘is this man guilty of a crime’ but, in the trial judge’s own framing, how legitimate are the funds with which these assets were acquired. The architecture is familiar to every practitioner in this field. The Commission places before the court material grounding a reasonable suspicion that assets are the proceeds of unlawful activity; the court orders interim forfeiture and public notice; and the evidential burden then shifts to those who claim the assets to explain, with documents and credible testimony, the lawful income from which such wealth could have come. Where the explanation is furnished, the property is released, as nine of these properties were. Where it is not, the inference the law permits is drawn. Readers of my work will recognise in this the very question to which I have devoted a three-volume study: the problem of unexplained wealth, of assets grossly disproportionate to every known lawful income of their holder, and of a legal order that has decided, correctly in my view, that such wealth may be called upon to explain itself.\u003C\u002Fp>\n\n\n\n\u003Cp>Two cautions follow, and I state them with emphasis. First, the forfeiture is not a conviction. Mr. Malami has been convicted of nothing; the criminal charge against him and his family remains to be tried, and he enjoys there, in full measure, the presumption of innocence that the Constitution extends to every accused person, together with the right to appeal the forfeiture itself. He has contested the proceedings vigorously, accusing the Commission of inflating the value of the assets, and it is his right to press every such point through every lawful avenue. Secondly, the release of the nine properties deserves as much attention as the forfeiture of the forty-eight, for it demonstrates that the court sat as a court and not as a rubber stamp: the Commission was put to proof, and where its proof failed, it lost. Both halves of the ruling, the forfeiture and the release, are the system working.\u003C\u002Fp>\n\n\n\n\u003Cp>\u003Cstrong>The Wheel, And What It Teaches\u003C\u002Fstrong>\u003C\u002Fp>\n\n\n\n\u003Cp>I am conscious of the irony, and I decline to gloat over it. The official who once catalogued, in a memorandum to the President, the alleged failures of the EFCC in the management of recovered assets, now watches the asset-recovery machinery of that same Commission applied to property associated with him. The prosecutor of one season has become the respondent of another, just as the EFCC chairman who succeeded Magu was himself, in his turn, suspended and detained. There is a lesson in this procession, and it is not the cheap one. It is that in a Republic governed by law, the machinery of accountability outlives every minister who operates it, and must; that those who wield extraordinary powers should wield them with the humility of men who may one day stand at the receiving end; and that the only lasting protection any public officer has is not office, or connection, but the integrity of the process itself, kept scrupulously fair for everyone, because everyone may need it.\u003C\u002Fp>\n\n\n\n\u003Cp>The contrast in process between 2020 and 2026 is itself instructive. Magu’s reckoning was conducted by an ad hoc panel, in camera, upon a report never published, and it ended in silence. The Malami forfeiture has been conducted in open court, upon motions argued and ruled upon, by judges whose reasons are on the record and whose orders are appealable. Whatever one’s view of either man, the second process is the constitutional one, and the difference between them is the difference this column has spent years urging: accountability through institutions, in public, on evidence, with rights of defence and appeal, rather than accountability by presidential panel, press leak and abandonment. The 2022 reform that placed the recovery and management of criminal assets on a statutory footing, with the Proceeds of Crime (Recovery and Management) Act, was Parliament’s answer to the very controversies over recovered assets on which the Magu affair was built; the courts’ growing mastery of the non-conviction-based forfeiture jurisdiction is the judiciary’s contribution; and what remains is the discipline to apply these instruments evenly, to allies and adversaries of every government alike, for an anti-corruption law that bends with the political wind is not law but weather.\u003C\u002Fp>\n\n\n\n\u003Cp>Let me end where a lawyer should, with the files. Six years ago I argued that my client was entitled to due process, to confrontation, to proof, and to a published outcome, and I hold today, with perfect consistency, that Mr. Malami is entitled to exactly the same: a fair trial of the charges, a fair hearing of any appeal, and judgment on evidence rather than on irony. The law’s promise is not that the mighty will fall; it is that everyone, mighty and small, accuser and accused, will be judged by the same rules, in the open, on proof. That promise failed Ibrahim Magu in 2020 in the manner of his treatment, whatever the merits; it is being kept, so far, in the Federal High Court in 2026. The wheel of accountability turns slowly in Nigeria, but this week it turned in public, on evidence, with reasons. misinformation circulating on social media, the inclusion of the Chief Judge’s photograph made it necessary to issue a clarification to protect the integrity of the judiciary.\u003C\u002Fp>\n\n\n\n\u003Cp>It issued a stern warning to content creators and social media users against publishing unverified information capable of misleading the public or undermining The Independent National Electoral Commission INEC on Thursday said it is set to conduct a comprehensive audit of its systems ahead of the 2027 general election in order to forestall a repeat of the technical glitches that trailed the 2023 presidential election.\u003C\u002Fp>\n\n\n\n\u003Cp>This was as it raised concerns over disinformation and the criminal deployment of Artificial Intelligence AI in the electoral process.\u003C\u002Fp>\n\n\n\n\u003Cp>The Commission gave the assurance when its Chairman, Prof. Joash Amupitan SAN, received the United Kingdom High Commissioner to Nigeria, Dr Richard Montgomery and his team at the Commission&#8217;s headquarters in Abuja.\u003C\u002Fp>\n\n\n\n\u003Cp>Amupitan described the visit as part of ongoing collaboration between both countries on election and cyber security ahead of 2027.\u003C\u002Fp>\n\n\n\n\u003Cp>The INEC Chairman told the visiting delegation that the Commission&#8217;s preparations had been shaped by extensive post-election reviews involving political parties, civil society organisations, the media, security agencies, development partners, election observers and its own officials, noting that &#8220;those reviews have informed virtually every aspect of our current preparations.&#8221;\u003C\u002Fp>\n\n\n\n\u003Cp>On the technology front, the Chairman disclosed that rather than overhaul its existing platforms outright, the Commission had opted to improve on them, including the rollout of self-service, online voter registration that eliminates the need for prospective voters to visit registration offices physically.\u003C\u002Fp>\n\n\n\n\u003Cp>&#8220;We started this a week ago, and we have gotten some very good, positive comments,&#8221; he said, adding that the goal was to ensure nobody is left behind in the process.\u003C\u002Fp>\n\n\n\n\u003Cp>The Commission also confirmed it had completed the first and second phases of the Continuous Voter Registration CVR exercise, with the third and final phase — originally scheduled to end in August — extended by two weeks to give more Nigerians the opportunity to register, in line with statutory timelines guiding publication of the voters&#8217; register before elections.\u003C\u002Fp>\n\n\n\n\u003Cp>On security of its infrastructure and personnel, the Chairman said INEC had undertaken a comprehensive review of its cybersecurity architecture, data systems, and penetration testing protocols, alongside disaster recovery mechanisms and communication systems, stressing that the Commission works closely with security agencies at national, state and local government levels through regular meetings to safeguard officials, infrastructure and voters alike.\u003C\u002Fp>\n\n\n\n\u003Cp>He acknowledged that public trust remained low but expressed confidence that the credibility of the elections would help rebuild confidence in the process.\u003C\u002Fp>\n\n\n\n\u003Cp>On the specific concerns around disinformation, he said the increasing use of AI to spread false information was one of the Commission&#8217;s major challenges, noting that INEC was looking to its partners, including the United Kingdom, for support in tackling the problem.\u003C\u002Fp>\n\n\n\n\u003Cp>The Chairman also disclosed that the Commission was considering budgeting for a full audit of its systems and the conduct of a mock presidential election ahead of 2027, though the plan was not originally part of its budget. &#8220;It was not originally in our budget, but if we need to get assistance in that direction, that can help us ahead of the election,&#8221; he said.\u003C\u002Fp>\n\n\n\n\u003Cp>On the legal front, the Chairman noted that the Court of Appeal had restored the electoral timetable, disclosing that the Commission had been working to navigate the process even before the restoration, and assuring that despite a compressed financial timeline, INEC would deliver a free, fair, inclusive and credible election.\u003C\u002Fp>\n\n\n\n\u003Cp>The Chairman, who noted he had been in office for about eight months during which he had superintended multiple elections while preparing for both the Osun State election and the 2027 general election, thanked the UK envoy for his consistent engagement with the Commission and reaffirmed INEC&#8217;s commitment to inclusivity, citing continued attention to women, youth and persons with disabilities in its electoral processes.\u003C\u002Fp>\n\n\n\n\u003Cp>&#8220;Our objective remains to deliver elections that are credible, transparent, inclusive and reflective of the sovereign will of Nigeria,&#8221; the Youth Party (YP), which instituted the case against INEC, lacked legal power (locus standi) to do what it did.\u003C\u002Fp>\u003Cp>Justice Banjoko said that the party did not explain how the aside the judgment of the Federal High Court which nullified part of the election guidelines put in place by the agency for the conduct of the 2027 general election.\u003C\u002Fp>\u003Cp>The Federal High Court in Abuja had invalidated the timeline issued by INEC for the conduct of primaries and the nomination of candidates, ahead of the 2027 general election.\u003C\u002Fp>\u003Cp>In a judgment delivered by Justice Mohammed Umar, it also set aside INEC&rsquo;s May 10 deadline requiring political parties to submit a register and database of all their members as a condition for qualifying to participate in the general elections.\u003C\u002Fp>\u003Cp>The court held that the time frame the electoral umpire announced for political parties to conduct their primaries and to submit, withdraw, or replace the names and particulars of their candidates for the general elections &ldquo;is inconsistent with the provisions of the Electoral Act, 2026.&rdquo;\u003C\u002Fp>\u003Cp>But in the appeal dated May 25, 2026, filed by INEC, through its counsel, Izinyon (SAN), the electoral body prayed the court to set aside the judgment.\u003C\u002Fp>\u003Cp>The senior advocate, in the appeal, also asked the court to stay the execution of the judgment.\u003C\u002Fp>\u003Cp>In the appeal, the electoral umpire raised nine grounds of appeal and prayed the court to set aside the Employment, Dr. Muhammadu Dingyadi, speaking at a public forum in Lagos, unveiled the Federal Government&#8217;s labour reform agenda and appealed to employers to partner with government in creating jobs, promoting decent work and strengthening enterprise competitiveness.\u003C\u002Fp>\n\n\n\n\u003Cp>According to him: &#8220;The success of these reforms depends significantly on a vibrant private sector. Government alone cannot create all the jobs our growing population requires. Consequently, the Ministry has continued to reposition labour administration as a strategic instrument for economic development.\u003C\u002Fp>\n\n\n\n\u003Cp>&#8220;Over the past three years, the Ministry has strengthened the machinery for the prevention and settlement of trade disputes through enhanced conciliation, mediation and social dialogue. Our emphasis has remained on preventing disputes before they escalate into industrial actions capable of disrupting productivity and economic activities. This approach has contributed to improved industrial relations across several sectors of the economy.\u003C\u002Fp>\n\n\n\n\u003Cp>&#8220;The Ministry has also intensified labour inspection activities to promote compliance with labour laws, improve occupational safety and health standards and ensure decent working conditions.
