Tinubu Moves Make Nigerians Jailed Abroad Serve Sentences In Nigerian Prisons

InformationNG about 2 hours 2 mins read

President Bola Ahmed Tinubu has asked the Senate to amend Nigeria’s existing prisoner-transfer law to make it possible for eligible Nigerians convicted in foreign countries to serve their prison sentences in Nigeria.

The proposed legislation, known as the Transfer of Convicted Offenders Enactment and Enforcement Amendment Bill 2026, seeks to amend the existing law, Cap 216, Laws of the Federation of Nigeria, 2004.

Tinubu’s request was conveyed to the Senate in a letter read by Senate President Godswill Akpabio during Tuesday’s plenary session. Following the presentation, Akpabio referred the bill to the Senate Committee on Rules and Business for further consideration.

If passed, the amendment would give Nigeria a broader legal framework for negotiating prisoner-transfer agreements with other countries, including nations outside the Commonwealth. This could create an opportunity for qualified Nigerian citizens serving prison terms abroad to complete their sentences in their home country, subject to the relevant legal requirements and agreements between governments.

The proposal comes amid several high-profile cases involving Nigerians convicted or imprisoned overseas. Among them are former Delta State Governor James Ibori, former Deputy Senate President Ike Ekweremadu, and Abidemi Rufai, a former aide to Ogun State Governor Dapo Abiodun.

Although Nigeria already has a prisoner-transfer arrangement with the United Kingdom, the proposed amendment is expected to expand the country’s options for reaching similar agreements with other nations.

However, the bill does not mean that every Nigerian imprisoned abroad would automatically be brought back home. Any transfer would depend on the individual’s eligibility, applicable laws and the existence of an agreement between Nigeria and the country holding the prisoner.

The proposed amendment will now undergo legislative consideration as the Senate begins examining its provisions and potential implications for Nigerians serving prison sentences overseas.
