FRSC To Appeal Court Judgment Halting Its Operations On Federal Highways In Kano

 

The Federal Road Safety Corps (FRSC), Kano Sector Command, has said it is appealing the recent judgment of the Federal High Court in Kano that restricted its enforcement activities on roads under the control of the Kano State Government and local government councils.

In a statement issued on Saturday by the Sector Public Education Officer, Abdullahi Labaran, on behalf of the Sector Commander, the Corps said the judgment does not affect its statutory mandate to operate on federal highways across Kano State.

The FRSC said the clarification became necessary following public reactions and social media commentaries regarding the court’s ruling, which it said had created misconceptions about the scope of the judgment.

The development follows Thursday’s decision by the Federal High Court in Kano, where Justice M. S. Shuaibu ruled that the Corps lacks the legal authority to carry out enforcement operations on roads under the control of the Kano State Government and its local government councils.

The court ruled in favour of Kano-based lawyer Abba Hikima, who challenged the legality of the Corps’ operations after he was reportedly stopped and delayed by FRSC personnel on a township road in July 2025.

The court restrained the Corps from stopping or interfering with motorists on state and local government roads without lawful authority. It also ordered the FRSC to publish a public apology in a national newspaper and awarded the plaintiff ₦800,000 as damages and litigation costs.

But reacting to the judgment, the FRSC said it remains a law-abiding institution that respects the judiciary and the rule of law. However, it maintained that the ruling does not invalidate its powers under the FRSC (Establishment) Act, 2007, particularly regarding enforcement on federal highways.

According to the Corps, its operational jurisdiction in Kano includes major federal roads such as the Kano–Zaria Road, Kano–Katsina Road, Kano–Maiduguri Road, Kano–Hadejia Road, Kano Western Bypass, Kano–Gumel Road, Sharada–Madobi Road, Eastern Bypass, IBB–Katsina Road, BUK Road, Airport Road, Murtala Mohammed Way–Hadejia Road, Ibrahim Taiwo Road, Aminu Kano Way, Gwarzo Road, and other designated federal highways.

The command also cautioned against social media posts encouraging members of the public to confront or disregard FRSC personnel, describing such messages as misleading and capable of undermining lawful enforcement and public safety.

It further stated that it had identified what it described as procedural issues in the court proceedings, adding that its defence was not adequately considered before the judgment was delivered.

The FRSC said it has commenced the process of appealing the decision and, pending the outcome of the appeal, will continue to discharge its statutory responsibilities professionally and in accordance with the law on federal highways within Kano State.

The Corps urged motorists and other road users to remain law-abiding, cooperate with duly identified FRSC personnel performing lawful duties, and avoid actions capable of obstructing law enforcement officers or disrupting public order.
