Man wins case to retain voter’s card at revising court

Magistrate I Jallow of Kanifing has ordered that the name of one Adama Bah be retained on the register of voters after dismissing a claim objecting his possession of a voter card.

The objection was filed against him by one Ebrima Ndow who claimed that Bah is not a Gambian citizen.

In her judgement, Magistrate Jallow, ruled that the evidence falls short of the threshold required by section 28(2) (6) of the Elections Act 2025 because the objector has not proved to the satisfaction of the court that Bah is not a Gambian citizen.

She accordingly dismissed the objection and ruled that the name of Adama Bah shall be retained on the register of voters in the relevant constituency.

She further ruled that the appropriate entry be made in the voters’ list in accordance with section 28(6) of the Elections Act, 2025.

The court reminded the claimant of his right to appeal by giving notice in writing to the Revising Court of his or her desire to appeal to the High Court within two days after the decision is given.

Senior Magistrate Jallow further stated that the court cannot expunge a person’s name from the voters register merely because one person suspect that the person is a foreign national. “There must be evidence upon which the court can properly conclude that the statutory qualification has not been satisfied,” Jallow ruled.
