No-nonsense magistrate slams 10 years on another rapist in Basse

The Basse Magistrate’s Court has sentenced one Omar Jallow to a mandatory jail term of 10 years with hard labour after he admitted and was subsequently found guilty of raping a 19-year-old girl in Basse.

Senior Magistrate Ismaila Dibba further ordered the convict, Omar Jallow, to pay D500,000 to the victim as compensation, in default to serve an additional two years in prison.

He was found guilty on a single count charge of rape, and he was unrepresented.

In delivering his judgement, the magistrate Dibba stated: “The evidence before this court establishes that the convict committed rape in a manner that was callous, insensitive, and demonstrative of a shocking disregard for the bodily integrity, dignity, and humanity of the victim. The assault was of such violence that the victim continued to bleed for several days thereafter,” he said.

He said the bloodstained clothing tendered in court stood out as “a stark and disturbing testament to the severity of the injuries inflicted and the trauma endured”.

Magistrate Dibba added: “Rape is not merely a sexual offence. It is an offence of violence, domination, and profound violation. It strips the victim of autonomy, inflicts deep psychological wounds, and often leaves scars that endure for a lifetime. In this case, the physical injury was compounded by the irreversible loss of the victim’s virginity and the attendant social, emotional, and psychological consequences that flow therefrom in our societal context.”

He further told the court that there is need to protect girls and women in The Gambia from sexual violence and to affirm court’s zero tolerance stance against rape.

“Under The Gambia’s legal framework, rape is among the most serious offences against a person, attracting severe punishment to reflect societal condemnation, deter potential offenders, and protect the vulnerable. While an early guilty plea ordinarily warrants a discount in sentence, such discount is not automatic and must be calibrated against the gravity of the offence and the harm caused,” he stated.

The magistrate said the sentence imposed was intended not only to punish the convict but also to serve as a stern warning to all who may contemplate such actions.
